The Directorate for Priority Crime Investigation (Hawks) has confirmed that 38 out of 40 accused appeared in court on 26 March 2026 in connection with the R114 million Mpumalanga Department of Basic Education corruption case.

The accused are facing multiple charges, including corruption, fraud, theft, money laundering, and violations of the Public Finance Management Act. They were previously granted bail ranging between R5 000 and R50 000 during court proceedings held from 23 to 27 February 2026.

Two accused, Consolation Mdluli and Brigitt Mthalana, failed to appear in court. Their legal representatives cited medical reasons for their absence. The court authorised warrants of arrest for both individuals, which were conditionally withheld. Mthalana is expected to appear on 10 April 2026, while Mdluli is scheduled to return to court on 2 July 2026. Failure to comply may result in the execution of the warrants and possible forfeiture of bail.

In a related development, Ruth Khoza has been instructed to appoint private legal representation after being found ineligible for Legal Aid due to her financial status.

The matter has been postponed to 2 July 2026 for docket and charge sheet disclosure. All accused are expected to appear in person.

The Provincial Head of the Hawks in Mpumalanga welcomed the progress, stating that investigations remain focused on ensuring accountability and tackling corruption within public institutions.
